IMPOSING MAXIMUM PRICES FOR PILOTAGE SERVICES AT VIETNAMESE REPORTS
THE MINISTER OF TRANSPORT
Pursuant to the Vietnam Maritime Code dated November 25, 2015;
Pursuant to the Law on Prices dated June 19, 2023;
Pursuant to the Government’s Decree No. 56/2022/ND-CP dated August 24, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Transport;
Pursuant to the Circular No. 12/2024/TT-BGTVT dated May 15, 2024 of the Minister of Transport on mechanisms and policies for management of service prices at Vietnamese seaports;
At the request of the Director General of the Department of Transportation and the Director General of the Vietnam Maritime Administration.

Article 1. Imposing maximum prices for pilotage services at Vietnamese reports under this Decision. The prices specified in this Decision are exclusive of value-added tax.
Article 2. Regulated entities
This Decision applies to Vietnamese organizations and individuals, foreign organizations and individuals involved in the provision and use pilotage services at Vietnamese seaports.
Article 3. Maximum prices for pilotage services charged on domestic vessels
1. Expressed as unit price: The maximum price for pilotage service charged per pilotage trip equals (=) the maximum unit price specified in Sections 1, 2, 3, 4, 5 and 7 clause 1 of this Article multiplied by (x) the distance of pilotage multiplied by (x) the gross tonnage of a vessel. Regarding Section 6 clause 1 of this Article, the maximum price for pilotage service equals (=) the maximum unit price specified in Section 6 clause 1 of this Article multiplied by (x) the gross tonnage of the vessel.

3. Progressive prices for pilotage services specified in clause 2 of this Article for vessels of 80.000GT or more (not applicable to passenger vessels and liquid cargo vessels), export, import, transit:
a) The price for the tonnage exceeding 80.000 GT but not exceeding 120.000 GT shall be 50% of that specified in clause 2 of this Article;
b) The price for the tonnage exceeding 120.000 GT but not exceeding 160.000 GT shall be 40% of that specified in clause 2 of this Article;
c) The charge for the tonnage exceeding 160.000 GT shall be 30% of that specified in clause 2 of this Article.
4. Charged per pilotage trip: the maximum price for international pilotage service charged per pilotage trip.
a) The maximum price for pilotage service charged per pilotage trip as prescribed Sections 1, 2, 3 and 7 clauses 1 and 2 of this Article is USD 300;
b) The maximum price for pilotage service charged per pilotage trip as prescribed Sections 4 and 5 clause 1 of this Article is USD 200;
c) The maximum price for pilotage service charged per pilotage trip as prescribed Section 6 clause 1 of this Article is USD 100;
d) The maximum price for pilotage service charged per pilotage trip for a vessel of less than 200 GT (including fishing vessels) is USD 40;

Article 5. Specific pricing regulations
1. In case the carrier changes the time of pilotage or cancels the request for pilotage in less than 03 hours (or 08 hours for offshore platform) prior to the initially requested time of pilotage, the carrier shall incur a wait charge of 30.000 VND/person/hour for domestic operation and USD 10/person/hour for international operation. If the situation also involves the vehicle, the wait charge shall be VND 200.000/person and vehicle/hour for domestic operation and USD 20/person and vehicle/hour for international operation. If the pilot has not set off, it will be considered 01 hour. If the pilot has set off, the period from the time of set-off to the time of return to the initial position of the pilot shall be at least 01 hour. The pilot will only wait at the pickup position for up to 04 hours after the initially requested time. After 04 hours, it will be the considered that the pilotage service is cancelled and the carrier shall pay 80% of the pilotage charge for the requested pilotage distance in accordance with Article 8 and Article 9 of this Decision.
2. If the pilot has boarded the vessel but the vessel is inoperable due to force majeure and such event is confirmed by the regional port authority, the price for pilotage service equals the minimum price for a pilotage trip pursuant to clause 2 Article 3 of this Decision (for domestic vessels) and clause 4 Article 9 of this Decision (for international vessels).
3. A carrier that does not voyage straight to the port and demands to anchor midway (except for the routes on which night voyage is not allowed) shall incur an additional charge for transporting the pilot. The price for pilotage service shall not exceed VND 300.000 per vessel per trip for domestic vessels, and USD 30 per vessel per trip for international vessels.
4. If the vessel has arrived at the pilot wait position punctually and a representative of the owner has obtained an approval from the port authority but the pilot is absent and keeps the vessel waiting, the pilot shall pay the vessel owner a wait charge of VND 250.000/hour for domestic operation, or USD 100/hour for international operation, for the actual number of hours over which the vessel is kept waiting.
5. In the event that a vessel (except passenger vessels) has at least 04 visits to a maritime zone in the month, from its 4th visit in the same month, the maximum price for pilotage service shall be 80% of that defined in Article 3 and Article 4 of this Decision but must not be lower than VND 2.000.000 for domestic vessels and USD 300 for international vessels.
6. In the event that a passenger vessel has at least 4 visits to a maritime zone in the month, from its 4th visit in the same month the maximum price for pilotage service shall be 80% of that defined in Article 3 and Article 4 of this Decision but must not be lower than VND 2.000.000 for domestic vessels and USD 300 for international vessels.
7. The pilotage charge for an international vessel of at least 50.000 GT, upon its entry into and departure from a maritime zone, shall be 40% of that defined in Article 3 and Article 4 of this Decision but must not be lower than USD 300.
