Tóm tắt Quyết định số 90/2000/QĐ-BTC - Phần mở đầu và các điều khoản đầu (Từ Điều 1 đến Điều 4)
Quyết định số 90/2000/QĐ-BTC được ban hành ngày 01 tháng 06 năm 2000 quy định về việc ban hành biểu mức thu phí kiểm tra chất lượng, an toàn và vệ sinh thủy sản. Dưới đây là phần tóm tắt chi tiết và phân tích chuyên sâu các nội dung cốt lõi từ phần mở đầu đến Điều 4 của văn bản này:
1. Phần mở đầu và căn cứ pháp lý ban hành
Phần mở đầu của Quyết định thiết lập cơ sở pháp lý vững chắc cho việc thu phí, dựa trên các văn bản quy phạm pháp luật quan trọng thời kỳ đó về phí, lệ phí và quản lý chất lượng hàng hóa. Việc ban hành quyết định này nhằm mục đích thống nhất quản lý nhà nước về tài chính đối với hoạt động kiểm tra chất lượng, bảo đảm an toàn vệ sinh thực phẩm thủy sản xuất nhập khẩu và tiêu dùng nội địa.
2. Ban hành biểu mức thu phí (Điều 1)
- Quy định việc chính thức áp dụng biểu mức thu phí kiểm tra chất lượng, an toàn và vệ sinh thủy sản kèm theo Quyết định này.
- Biểu phí là căn cứ pháp lý duy nhất để các cơ quan chức năng thực hiện việc thu phí đối với các hoạt động kiểm tra, kiểm nghiệm thủy sản.
3. Đối tượng nộp phí và phạm vi áp dụng (Điều 2)
- Đối tượng nộp phí: Áp dụng đối với tất cả các tổ chức, cá nhân trong nước và nước ngoài khi được cơ quan quản lý nhà nước có thẩm quyền tiến hành kiểm tra chất lượng, an toàn vệ sinh thủy sản.
- Nghĩa vụ tài chính: Các đối tượng thuộc diện kiểm tra có trách nhiệm nộp đầy đủ, đúng thời hạn các khoản phí theo đúng biểu mức quy định trước khi nhận kết quả kiểm tra hoặc chứng thư chất lượng.
4. Quản lý và sử dụng nguồn thu từ phí (Điều 3)
Điều khoản này quy định chi tiết về nguyên tắc quản lý tài chính đối với nguồn thu từ phí kiểm tra chất lượng thủy sản:
- Kê khai và nộp ngân sách: Cơ quan thu phí có trách nhiệm mở tài khoản tạm giữ tiền phí, thực hiện kê khai, nộp và quyết toán tiền phí thu được vào Ngân sách Nhà nước theo đúng quy định của pháp luật hiện hành.
- Trích để lại đơn vị: Cho phép cơ quan thu phí được trích lại một tỷ lệ phần trăm nhất định trên tổng số tiền phí thu được để trang trải chi phí cho công tác kiểm tra, thu phí và đầu tư nâng cao năng lực kiểm nghiệm. Phần còn lại phải nộp đầy đủ vào Ngân sách Nhà nước.
5. Hiệu lực thi hành và trách nhiệm tổ chức thực hiện (Điều 4)
- Hiệu lực thi hành: Quyết định có hiệu lực thi hành sau 15 ngày kể từ ngày ký ban hành. Các quy định trước đây về phí kiểm tra chất lượng, an toàn vệ sinh thủy sản trái với Quyết định này đều bãi bỏ.
- Trách nhiệm thi hành: Các tổ chức, cá nhân thuộc đối tượng nộp phí, các cơ quan thu phí trực thuộc Bộ Thủy sản (nay là Bộ Nông nghiệp và Phát triển nông thôn) và các đơn vị liên quan chịu trách nhiệm thi hành nghiêm túc các quy định tại Quyết định này.

Pursuant to the Government’s Decree No.15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and ministerial-level agencies;
Pursuant to the Government’s Decree No.178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Finance Ministry;
Pursuant to Clause 3 of Article 4 and Clause 2 of Article 7 of the Government’s Decree No.86/CP of December 8, 1995 on the division of responsibilities for State management over goods quality;
Pursuant to Clauses 6 and 7, Article 2 of the Government’s Decree No.50/CP of June 21, 1994 on the tasks, powers and organizational structure of the Ministry of Aquatic Resources;
Pursuant to the Government’s Decree No.04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget;
After consulting the Ministry of Aquatic Resources and at the proposal of the General Director of Tax,
DECIDES:
Payers of fees for aquatic product quality, safety and hygiene control at the levels prescribed in this Article are domestic and foreign organizations and individuals engaged in the production and trading of aquatic products, that are provided with aquatic product quality, safety and hygiene inspection by the State agencies according to the provisions of law.
